David J. Thibodeau, Jr.
David Thibodeau’s law practice emphasizes the building and refining of patent portfolios, strategic advice concerning competitive intellectual property rights, and due diligence for technology-based financial, merger/acquisition, and other business transactions. David began his career in industry as an electrical engineer and later served as Vice President and General Counsel of a wireless communications company. Over the years, David has used this business-related expertise to bring value to his clients during counseling and management of specific projects. He represents clients in a range of industries but has specific expertise with wireless communications, data storage, network security, semiconductors, precision optics, and audio systems. Some of David's representative matters include: - Supported due diligence in a $1B+ “going private” transaction for a publicly traded Massachusetts manufacturer
- Provided strategic advice leading to successful resolution of a patent litigation prior to a major private acquisition of a start up company
- Performed due diligence in connection with a $1.5B+ liquidity event for a network attached storage client
- Built significant patent portfolios leading to license revenue and/or client acquisitions in the cable television, semiconductor, global positioning system, and flat screen display industries
- Developed a patent portfolio applicable to 3G wireless standards resulting in over $200M in license revenue to the acquiring company
- Settled a patent interference matter for a mid-sized manufacturer against a Fortune 50 company resulting in a successful cross license
- Routinely advises venture capital and angel investors in connection with early stage funding of technology startups
