The Final Score: USPTO Rescinds the New PTO Rules Package -- Applicants WIN!October 2009 The USPTO, under the new leadership of David Kappos as Under Secretary of Commerce for Intellectual Property and Director of the USPTO, has decided to rescind the controversial New Rules of Patent Examination proposed in August 2007 and plans to file a motion to dismiss the appeal pending in the Federal Circuit. The new Rules would have limited the number of continuation applications, Requests for Continued Examination (RCEs) and claims that could be filed by applicants.
