A Look at Design Patents and the Implications of Apple v. Samsung

This past year saw the revival of the generally overlooked design patent.  In fact, design patents covering the iPhone were front page news in the "smart phone" battle between Apple and Samsung.  This seminar will take an extensive look at design patents from the basics of design patent prosecution to the strategic value such patents may have for your intellectual property portfolio.  The seminar will conclude by presenting the surprising successes design patents have played in hard fought litigations between competitors.

This seminar, which will provide a visual tour of the world of design patents, will be presented by attorneys Brian Moriarty, Mary Lou Wakimura and Darrell Wong from Hamilton Brook Smith Reynolds.  The seminar will also present a discussion by seasoned in-house counsel from IBM and New Balance.  This will be a highly instructive and useful discussion on why design patents may be a new essential tool for your company.

The topics to be addressed include:

  • design patents as part of your intellectual property portfolio;
  • strategies for United States Patent and Trademark Office prosecution;
  • litigation tactics for design patents; and
  • review of patents and jury instructions in actual litigation, including the Apple v. Samsung case.
